But assuming you are correct, why wouldn't he be surprised at his situation IF HE DIDN'T DO IT?

What I remember is that when asked if he killed the president, he replied that he hadn't been charged with that. Is this when he looked surprised?

Personally I think the snippets of reactions, expressions and comments we get from LHO intermittently during those 48 hours leads to more questions than answers, to my way of thinking.  I think there are many ways to interpret them and depending on your pre-disposition and beliefs about what probably happened, his comments and reactions can satisfy those, from any perspective.  Which is SO unfortunate.  I watch and re-watch those brief film clips, which are the only ones we have directly and not diluted from the filter of others about him,  and I can take away so many different reactions to them.
