I would say that any character fictional or otherwise that is featured in a comic book named after him/her qualifies as a 'comic book hero.'

Just 'cause, literally, that is what that character is.

Some uses of a term have specific meanings. For example, a "French-Canadian" refers to an Acadian descended person, not every Canadian person who speaks French. The phrase "foreign object" does not mean necessarily an object manufactured in China embedded in the torso of a US citizen in his home in Nebraska. A "drinking problem" usually refers to addiction to alchoholic beverages, not someone who drinks too much coffee, I suppose.
