I dunno, that seems like a weak basis for a lawsuit. Of course, the advertising for the new movie--which I saw last night--does claim that it's based on a true story, and yet the elements of the haunting are completely different from those Lutz claims happened to him and his family. What goes on seems much more inspired by (a) recent Japanese horror movies [the principal ghost is a little girl] and (b) THE SHINING, primarily the novel: man and family move into weird old house, he develops a fixation on the furnace, and eventually carries an axe as he tries to hunt everyone down. The real names are used for most of the characters.
