(06/20/08 1:01 PM) Reply Quote More My Recent Posts Message Me Connection Blocking Invite	I agree with dogstar67 that we need an impartial person to review all this legal mumbo-jumbo and report just what in the heck is going on. Right now it's a lot of "He Said - She Said." I read a lot about the legal rulings from one side, then the other, but see no legal documents at all. A while back on the FM website Mr Ferry posted what he said were legal documents which, if I understood him correctly, said that they were proof of how the FM trademark was sold illegally. I downloaded the PDF files and look them over. I'm no lawyer but it looked like these documents were nothing more than filings that Mr. Ferry had sent to the courts describing what he felt were misdeeds by others concerning the sale of the FM trademark. I saw no documents that showed that on a certain date Mr. Ferry was the legal owner of the trademark and on that date Mr. X had sold it to Mr. Y. Now that doesn't mean that those documents don't exist, it's just that Mr. Ferry never posted any real proof to his assertions. This is definately an interesting situation that is unfolding, and hopefully everything will work itself out in an orderly and legal fashion. Since Mr. Kim and Connie Bean are both posting here, I hope both do not try to blacken the others eyes. Lets keep thing above board. Lets not have any name calling or write anything unkind about the other. This is a legal matter. Both sides truely believe that they are the legal owners of something. One is right, one is wrong. The one who is wrong will undoubtedly be upset by the ruling(s) but but our court system is, I believe, the best in the world. It's OK to post our feelings, but lets not get into any personal attacks on any of the members of this board. Let's all play nice here. We really need someone who can look at this objectively. Sadly we are all sceptics in our own right. I'm sure if Mr. X posted legal documents Mr. Y would say they are fakes. Any lawyers out there who aren't connected to this case and have access to the court papers?

(06/20/08 1:18 PM) Reply Quote More My Recent Posts Message Me Connection Blocking Invite	Mr. Crow, I don't believe I have resulted to name calling or threats although Mr. Kim, who has now shown himself to be FMFL, has resorted to that when he asked that Ray and I "go back to the hell from which we were spawned" and other statements in his last post about jail time and so forth which would lead this board to believe that we are supposed to be in jail. I believe if that were the case, it would not have taken then seven years to do it. I don't believe that Ray is hiding behind anyone, including me. I think that Mr. Kim is angry and well he should be, but his anger is misguided. We are not the one's who sold him the Brooklyn Bridge without the rights to drive on it. The ruling and pertinent information will be on our website if you choose to read it and if you choose to believe a document downloaded from the court directly. The waters are very murky but we are not the ones who keep making them murkier as each day goes by. I merely respond when I think my response is necessary. The property is so frayed from people pulling on it, the bone so scarred from folks chewing at it, or whatever sorry image you want to use, that it's becoming worth less and less every second. Such things only live by the support of public goodwill, and that is being drained away by each successive move of the combatants. This is all very reminiscent of the two foolish mothers driving Solomon to suggest that they cut their contested baby in half. Why don't these folks see that lesson? The Silver Age was a wonderful time in comics, but it is gone. Looks like so too is a peer of its era, FAMOUS MONSTERS OF FILMLAND magazine. Great weekend, anyway, -Craig W.

I've read your responses and you have ALWAYS been kind in your comments. What I meant to say in my way was that sometimes on these boards members have a tendency to name call or show disrespect to others, and then the Administrator has to come in and warn everyone to be nice, and he sometimes has to remove comments. That's a lot of time and energy involved for him. I hate to see people bad mouth others, and this topic is an especially touchy one. This goes back many years. There are the Forry lovers and the Forry haters. There are the Ferry lovers and the Ferry haters. Now there appear to be Kim lovers and Kim haters. People like to take sides based on emotions and not the facts. Unfortunately we don't really get to see all the court documents, etc. concerning this issue, and, truth be told, even if we did we probably wouldn't understand half of the legal mumbo-jumbo. I do look forwatd to seeing what is posted on the FM website concerning this situation. Again let me state that you - Connie - from what I have read here have ALWAYS been respectful in your posts. If what I wrote made you feel that i was finger pointing at you I respectfully appologize.

It is an accounting term for how much the company's image and perceived value in the future is worth. Goodwill is calculated and part of a company's worth on the market. Coca-Cola, for example, has "goodwill'' in the many billions of dollars because it is a worldwide brand with global recognition and reach. Goodwill is actually listed as part of what a company is worth, in addition to its physical properties (buildings, machinery), investments and stock valuation. It is not simply the company's reputation, although that can be part of it, but its perceived future value based on its history and potential. Many newspaper companies, including my own, have had to "write down" their valuation because their "goodwill"has been lessened by the perception that newspapers will not thrive in the future. Anyhow, goodwill is indeed something that is measured and has a value. How it figures in this case hasn't been explained very well, I must admit. And I'm more than ready to be corrected if I haven't explained the concept quite right.

(06/20/08 3:01 PM) Reply Quote More My Recent Posts Message Me Connection Blocking Invite	From the way I read the ruling, the issue before the Court seemed to be mainly domain names & who has the right to use them. It seems to me the Bankruptcy Court stated the sale order stood and that it included the Trademark. The Court stated it no longer has jurisdiction and any disputes between Mr. Kim and Mr. Ferry will have to be resolved in either a state court or federal court. Here's the Tenative Ruling as posted on Mr. Ferry's site - http://www.filmlandclassics.com/ruling.jpg It does not appear to me that the issued is either resolved or any closer to being resolved. I am very sorry if this sounds crass, but where does anything in this whole case say that Forry was ever screwed out of the rights? Forry never owned any rights to the trademark. I realize that you are angry because Forry is no longer involved in the magazine, but remember that was his choice. I believe that Forry had many years before Ray brought the magazine back to life to have started the magazine again and could have then aquired the trademark for himself. Not liking the way things are is one thing, but saying that Forry got screwed out of his rights is quite another. Incidentally, I know that because it was me in the courtroom, you would never believe anything I say but the Judge did say that it was never clear that the trustee had any rights to the trademark in the first place and since he never pursued it, then it's not a part of the estate that she now has jurisdiction over so therefore, take it elsewhere. Our posting said just that. No stretching no attacking merely posting what the Judge said and what she put in her ruling. Connie *Connie*

It reminds me of Bob Kane and greats of the comic age. The guy seems like the nicest man in the world and a real treasure, hell he corresponded with LOVECRAFT! I just think he should always be Editor Emeritus or if he didn't want it to continue, let it rest (besides reprints or memorabilia). Nothing, not even Dracula can last forever. But, I'm just being sentimental. Obviously, if some has the legal rights or ability to use them, then whoever they are should. The other thing was, I wanted to clarify was that the judge had no opinion on this matter and that it must be pursued in another court. As a law student understanding the written or spoken decision of a court is not that straightforward in the least. I just feel in this instance besides the domain, the matter still has to be resolved. I just objected to your interpretation of the judges order. The original owner of FM was James Warren. The trademark lapsed and that's when Ferry picked it up. He hired Forry when the magazine was revived. Ferry was the boss, not Ackerman. You write "who cares" in my question to you about whether you've ever seen (read) a Forry-less FM. I guess your response means that you've never seen such an issue, so, pardon the bluntness, but for you to say that a Forry-less FM is basically crap is, well, a very uninformed opinion--let's put it at that. It's a cavalier attitude like yours, based on misinformation and wild conjecture, that unfortunately always mars these FM threads. Mirek
