Oh? OK... you're at home with a fictional wife and kids, a stranger comes in the back door, and you shoot him. You thought he was a burglar, or a rapist, or a child-stealer. Turns out he wasn't. Do you send youself to prison for the rest of your life?
OK... you volunteer for armed service. In the course of action, you kill several "enemy" people and a couple dozen who you know had nothing to do with war. You come home. Some guy comes up to you in a 7-Eleven and asks for a buck. You flip out and strangle him because you thought he was one of the enemy. Does the judge and jury give you the death sentence? Life without parole?
A stranger comes to you to fix his broken leg. You do, and he leaves. You're arrested and tried for murder, conspiracy and treason for assisting John Wilkes Booth escape. Do you get life in prison (The answer here is, yes.)
Life is not simple. Justice has to be tempered with mercy and common sense. The statue of Justice holds a sword in one hand and a balance in the other, not a Howitzer.
